EMV Technology and Liability Shift

Dear Valued Merchant,

 

As we advised you last year, the ATM industry is evolving with new security technology and standards, including the adoption of Europay-MasterCard-Visa integrated chip card and compatible ATM card-reading technology (“EMV”). In an effort to incentivize ATM owners to adopt EMV technology, the payment networks are phasing in new liability shifting requirements. On October 1, 2017, Visa implemented regulations that require ATM owners who operate EMV non-compliant ATMs in the U.S. to bear the risk of liability associated with counterfeit fraudulent transactions perpetuated with Visa EMV compliant cards. MasterCard was the first major network to implement these changes beginning October 2016. Other networks may follow suit. A significantly higher percentage of Visa cards are used throughout the ATM industry and we expect that the cost of non-compliance with EMV after October 1, 2017 will increase dramatically. Since your ATMs are part of Visa (and other) networks, the critical date for EMV compliance by you, as an ATM owner was October 1, 2017.

As of October 1, 2017, you as an ATM owner are subject to the risk of liability associated with counterfeit fraudulent transactions perpetuated with Visa EMV compliant cards (in addition to MasterCard EMV compliant cards, which was effective October 2016, and other network EMV compliant cards) if any of your ATMs are not EMV compliant. Please note that the cash settlement bank account associated to your terminal will be debited for any counterfeit fraudulent transactions perpetuated with EMV compliant cards.

You are strongly encouraged to upgrade or replace your EMV non-compliant ATMs before the above deadlines so you are not left bearing the risk of liability for counterfeit fraudulent transactions. Doing nothing is a risky choice that could cost your business significant liability. Attached you will find a list of EMV compliant options, including new ATM machines available for purchase.
